Public Land Disposition and Development Negotiations

EPS has built a substantial portfolio of project experience involving the lease, transfer, and sale of publicly held assets to developers or other end users. Whether working on the public or private side of the table, EPS has consistently provided sound advice to clients on matters including market and financial feasibility, marketing strategies, RFQ/RFP writing, developer selection criteria, public policy and political considerations, and the development of mutually beneficial business terms as a part of contract negotiations.

In past assignments, we have found that a process composed of three basic steps provides a useful structure for the negotiation. These three steps comprise defining negotiation principles, negotiating a business term sheet, and drafting lease and other transaction documents. In addition, we strive to premise our negotiation strategy on a thorough understanding of project economics, regulatory parameters, and the structuring of business terms that are both definitive and flexible enough to serve over the long term.
