The City of Newark's existing development impact fees were outdated and relatively limited in scope, covering only art and parks-and-recreation-related capital improvements. Facing the prospect of significant new development in the near future, the City sought to approve a more comprehensive impact fee ordinance that adequately accounted for recent economic and demographic trends, a broader range of public facilities, and a changed public policy environment. Working for the City, EPS prepared a Public Facilities Impact Fee Nexus Study that established the required legal documentation to implement the development impact fees. EPS also worked with the City Attorney to develop the necessary enabling ordinance and resolution that were ultimately approved by the City.
